These Terms of Service (“Terms”) govern your access to and use of FinSpark, an educational financial literacy service for students in grades 3–12 operated by FinSpark, LLC. (“we”, “us”, “our”). By creating or using an account, purchasing services, or otherwise accessing FinSpark, you agree to these Terms and our Privacy Policy. If you are a parent or legal guardian acting on behalf of a child under 13, you must read and follow the Parental Consent and Verification provisions below.
1. Eligibility and Who May Use FinSpark
- Parent Accounts Only for Adults. Only adults who are the legal guardians of a child may create and operate a Parent Account and may use FinSpark’s parental features, including AI‑assisted quiz generation. By creating a Parent Account you represent and warrant that you are at least 18 years old and the legal guardian of the child for whom you are creating or managing the account.
- Student Accounts. Student Accounts are for children enrolled in grades 3–12. AI features are blocked on Student Accounts. Students may access quizzes and learning content only as permitted by their Parent Account and by these Terms.
- Compliance with Law. You must comply with all applicable laws, including COPPA and other laws protecting children’s privacy and safety.
2. Account Registration and Parental Verification
- Accurate Information. You must provide accurate, current, and complete information when creating an account and keep it updated.
- Parental Verification. To purchase or enable certain services (including custom AI‑generated quizzes, and or lessons), a Parent Account must complete our verification and consent process. Verification may include a valid credit or debit card transaction, an attestation that you are the child’s legal guardian, and any additional verification steps we reasonably require. We will retain records of verification and consent as described in our Privacy Policy.
- Single Operator Rule. Parent Accounts are intended to be operated only by the legal guardian who completed verification. Sharing or transferring parental control without our prior written consent is prohibited.
3. Parental Consent and Custom Quiz, and Lesson Flow
Overview. FinSpark offers a custom quiz and lesson feature that uses an anonymized snapshot of a student’s report card to generate a tailored quiz, and or lesson from a library of pre‑made questions, and information. This feature is available only after verifiable parental consent.
How the flow works
- Parent Request. A Parent Account requests a custom quiz for a specific Student Account.
- Parental Review and Consent. Before any data is sent to our AI service, the parent is shown the anonymized report card fields that will be used and a preview of the proposed quiz questions. The parent must:
- Review the anonymized data and proposed questions;
- Confirm they are the child’s legal guardian by typing their full legal name as an attestation; and
- Click a clearly labeled button confirming they have reviewed and consent to the data uses and to be charged for the service.
- Verification Record. We log the attestation text, timestamp, payment transaction ID, IP address, user agent, and the anonymized report card snapshot used to generate the quiz.
- AI Processing and Delivery. Only after the parent’s explicit attestation and verification do we send the anonymized report card snapshot to our AI service to generate the quiz. The completed quiz is delivered to the Student Account for the child to take.
- Revocation and Deletion. Parents may revoke consent and request deletion of associated data as described in Section 7.

"I certify that I am the legal guardian of the child associated with this account. I have reviewed the anonymized report card data and the proposed quiz questions. I consent to the collection and processing described in the Privacy Policy, including sharing anonymized report card data with the AI service for quiz generation. I understand I may revoke this consent and request deletion of data at any time. By typing my full legal name below I confirm my consent and authorization to be charged for this service."
4. Payments and Billing
- Payment Methods. We accept credit and debit cards and other payment methods we list on the site. By providing payment information you represent that you are authorized to use the payment method.
- Charges and Authorization. By completing the parental attestation and clicking the payment confirmation, you authorize us to charge the stated fee. We will retain payment records as required for billing, fraud prevention, and verifiable parental consent logging.
- Refunds and Cancellations. Refunds and cancellations are governed by our Refund Policy. If you dispute a charge, you must notify us promptly and follow the dispute process in the Refund Policy.
5. Data Use, Privacy, and AI Processing
- Privacy Policy. Our Privacy Policy explains what data we collect, how we use it, who can access it, retention periods, and how to request deletion. You must read and accept the Privacy Policy as part of these Terms.
- Data Minimization and De‑identification. For custom quiz generation we only send anonymized report card data to our AI service. We remove direct identifiers (name, email, student ID) and strip metadata that could reasonably identify the child. We document and log the de‑identification process.
- AI Vendor Commitments. We will only use AI services under written agreements that prohibit the AI vendor from using your inputs for model training or other secondary uses unless we obtain separate, verifiable parental consent. If we change vendors or vendor policies in a way that affects data use, we will notify parents and obtain any required consents.
- Student Account Restrictions. Student Accounts are blocked from invoking AI features. Only Parent Accounts may initiate AI processing. We log all AI invocations and maintain access controls and audit trails.
- No Student Identifiers Sent. We will not send student names, emails, or other direct identifiers to the AI service as part of the custom quiz flow.
6. Retention, Deletion, and Revocation of Consent
- Retention Periods. We retain parental consent records, payment records, and anonymized report card snapshots for the periods described in our Privacy Policy and as required by law.
- Deletion Requests. Parents may request deletion of their child’s data and revoke consent at any time. We will process deletion requests in accordance with the Privacy Policy and applicable law and will confirm completion to the requesting parent. Deletion may not be immediate for backup or legal reasons; we will document retention exceptions.
- Effect of Revocation. Revoking consent will prevent future AI processing and custom quiz generation. It will not retroactively undo quizzes already delivered to the Student Account unless deletion is feasible and requested.
7. Security and Access Controls
- Security Measures. We use administrative, technical, and physical safeguards to protect data, including encryption in transit and at rest, role‑based access controls, and logging.
- Access Limitations. Only authorized personnel and contracted service providers with a legitimate need may access data. Parent Accounts control access to their child’s Student Account and must keep credentials secure.
- Breach Notification. In the event of a security breach affecting personal data, we will notify affected parents and regulators as required by law.
8. Intellectual Property
- Our Content. FinSpark and its content, including question banks, curricula, and software, are owned by FinSpark, LLC. or our licensors. You may not copy, distribute, or create derivative works except as expressly permitted.
- User Contributions. Any content you submit (other than personal data) may be used by us to provide and improve the service consistent with these Terms and the Privacy Policy. You grant us a non‑exclusive, worldwide, royalty‑free license to use such contributions for service operation and improvement.
9. Disclaimers and Limitation of Liability
- No Professional Advice. FinSpark provides educational content only. Nothing on the platform constitutes legal, financial, or professional advice.
- Warranty Disclaimer. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
- Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNTS PAID BY YOU IN THE PRIOR 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
10. Termination
- By You. You may close your account at any time by following the account closure process. Closing an account does not relieve you of outstanding payment obligations.
- By Us. We may suspend or terminate accounts that violate these Terms, applicable law, or pose a security risk. We will provide notice where required by law.
- Effect of Termination. Upon termination we will handle data in accordance with the Privacy Policy and applicable law.
11. Changes to These Terms
We may modify these Terms. If changes are material, we will provide notice and obtain any required consents. Continued use after notice constitutes acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state specified in our corporate information. Disputes will be resolved as set out in our Dispute Resolution section in the full Terms and Privacy Policy.

14. Acknowledgment
By using FinSpark, creating a Parent Account, or purchasing services, you acknowledge that you have read and agree to these Terms and the Privacy Policy, that you are the child’s legal guardian if you operate a Parent Account, and that you consent to the data uses and billing described herein.
